1. About these terms
These Terms of Service govern the supply of creative design and marketing solutions by JT Creative Solutions Pty Ltd (ABN 95 701 298 624) of Perth, Western Australia ("we", "us", "our") to you, the client ("you"). By engaging our services, accepting a quote, or approving a project brief, you agree to be bound by these terms.
2. Our services
We provide creative design and marketing solutions, including but not limited to brand identity, graphic design, website design, social media content, print collateral, and marketing strategy. The specific scope, deliverables, and timeline for your project will be set out in your written quote or project brief.
Any work outside the agreed scope will be treated as a variation and quoted separately before it commences.
3. Quotes and engagement
- Quotes are valid for 30 days from the date of issue unless otherwise stated.
- A quote is an estimate of cost based on the brief provided. If the scope changes, we will advise you of any price adjustment before proceeding.
- Engagement is confirmed upon written acceptance of the quote and payment of any deposit specified in the quote.
4. Payment terms
- Unless otherwise agreed in writing, a deposit of 50% is required before work commences, with the balance payable on completion and prior to delivery of final files.
- Invoices are payable within 14 days of issue.
- Overdue invoices may attract interest at 2% per month, and we may suspend work on your project until outstanding amounts are paid.
- Prices are quoted in Australian dollars and include GST where applicable.
5. Client responsibilities
You agree to:
- Provide accurate briefs, content, images, logos and other materials required for the project;
- Confirm that you hold the necessary rights or licences for any materials you supply to us;
- Provide feedback and approvals within a reasonable timeframe, as project timelines depend on timely responses;
- Await written approval of final concepts before arranging printing or publication.
Delays caused by late materials or feedback may affect agreed delivery dates.
6. Revisions
Unless otherwise stated in your quote, each deliverable includes two rounds of revisions. Additional revision rounds, or substantial changes to an approved concept, will be quoted as a variation.
7. Intellectual property
- Upon full payment, you own the final approved deliverables created specifically for your project.
- We retain ownership of preliminary concepts, drafts, working files, and any unused designs.
- We retain the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
- Any third-party assets used in your project (such as stock imagery, fonts, or plugins) remain subject to the licence terms of their respective providers.
8. Confidentiality
Both parties agree to keep confidential any commercially sensitive information shared during the engagement, and not to disclose it to third parties without written consent, except where required by law.
9. Third-party services
Where a project involves third-party services (such as hosting, domain registration, printing, advertising platforms, or software subscriptions), those services are governed by the relevant provider's own terms. We are not responsible for outages, price changes, or policy changes imposed by third-party providers, though we will always advise you promptly of anything that affects your project.
10. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), including the consumer guarantees. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
If our services fail to meet a consumer guarantee that applies, you may be entitled to a remedy. To make a claim or raise a concern, contact us at ceo@jtcreativesolutions.site and we will work with you to resolve the matter fairly and promptly.
Where the Australian Consumer Law applies and we are liable for a breach of a consumer guarantee, our liability is limited (to the extent permitted by law) to the supply of the services again or the cost of having the services supplied again.
11. Limitation of liability
To the fullest extent permitted by law, and subject to section 10 above, we are not liable for any indirect, incidental, or consequential loss arising from the use of our services, including loss of profits or business opportunity. Our total liability for any claim arising under these terms is limited to the fees you paid us for the relevant project.
12. Termination
Either party may terminate an engagement by written notice. If you terminate a project after work has commenced, all work completed to date, plus any third-party costs incurred on your behalf, remains payable. If we terminate without cause, you will only pay for work completed to the date of termination.
13. Privacy
We handle personal information in accordance with our Privacy Policy. Information you provide is used only to deliver our services and communicate with you about your project.
14. Governing law
These terms are governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
15. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page. The terms that apply to your project are the terms in effect on the date you accept your quote.
